Jesmond Mizzi Financial Services Limited (the ‘Company’) is required by law to comply with the Data Protection Act (the ‘Act’). It is the Company’s commitment to ensure the confidentiality of any personal data held by the Company, in whatever form, in accordance with the Act.
The Company needs to keep certain information on its individual customers to allow it to comply with its legal obligations, and its commitments to its customers. Information on customers must therefore be processed by the Company who will retain such information in accordance with the Act.
The Company considers it important to protect its customers’ interests and has therefore issued this Data Protection Policy to make its customers aware of its practices in data protection and also to inform its customers of their rights with respect thereto.
Purposes for Processing Data
The Company will only collect data relating to its customers from the individual customer himself/herself.
The personal data processed by the Company will depend on the purpose for which the data is collected. The Company processes as minimal data as is possible, depending on the circumstances for which the data is processed.
Data on investing customers is required to ensure correct processing of one’s investment application and investment holdings. Data is also required by the Company in satisfaction of its anti-money laundering obligations. Certain data is also processed by the Company for marketing purposes.
Any personal data transmitted to the Company by the customer through its website shall only be used by the Company for marketing purposes.
Data Subject’s Obligations
Customers must ensure that all personal data provided to the Company is accurate and up to date. They must also ensure that all changes in their personal data are notified to the Company. The Company will thus keep personal data that is at all times accurate and up to date.
Customers who do not wish to receive promotional material should inform the Company accordingly.
Notification of Data Processed
The Company will provide all its customers on request, details of the data that the Company processes in their respect, and the reasons for which it is processed. A customer also has the right to request the rectification, amendment or erasure of any personal data that is held by the Company.
Any person who wishes to exercise this right should make his/her request in writing on the Company’s Request Form.
Non-Disclosure of Data
The Company does not disclose, whether orally or in writing, any personal data to any unauthorized third party.
Data may be transferred, even abroad, in connection with a customer’s investments in pursuance of agreements made by the customer. Personal data shall also be disclosed to relevant competent authorities in pursuance of the Company’s legal obligations. The Company may also disclose personal data to companies within the group solely for promotional reasons.
Retention of Personal Data
The Company has established retention periods, following which, unnecessary data is deleted.
In general all data will be kept for the retention period required by law. There is however certain data that will be kept for longer periods, such as data required for providing a better customer service, or where a customer has consented to receiving marketing materials from the Company.
The Company can at any time terminate an account.
